You and Protocol Yield agree that any claims relating to these Terms of Service or to your relationship with Protocol Yield as a User of the Services (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claims arise during or after the termination of these Terms of Service) shall be brought against the other party in an arbitration or as per consumer choice to other dispute resolution institution on an individual basis only and not as a plaintiff or class member in a purported class or representative action. Key Considerations Before Launching a Profit-Sharing Service

Profit Sharing – PAMM Account

Managing your service is as critical as managing your trades. A PAMM (Percentage Allocation Management Module) account enables wealth managers to trade on behalf of multiple investors through a single account. Profits and losses are distributed proportionally based on each investor’s share of the total funds.

Since profit sharing is based on success fees, your objective is to generate returns for both your investors and yourself.

Success Fee (SF)

A Success Fee is a percentage of real profits earned for investors. You set the percentage, but consider:

5% is allocated to Protocol Yield. If your SF is 30%, you receive 25%, and 5% goes to Protocol Yield.

Managers do not pay the success fee.

The minimum SF is either 0% or 10%. At 10%, 5% goes to the manager and 5% to Protocol Yield; at 0%, no fees are charged.

Example:

If an investor earns 100 USDT above their HWM and your SF is 25%, the distribution is:

If a service has 10,000 USDT AUM and invests 5,000 USDT in ETH, and ETH rises 15% within a day (but remains unsold), the new total balance is 10,750 USDT, reflecting 750 USDT in unrealized profits (7.5%).

To ensure real profits, two systems are used:

1. High Water Mark (HWM): The highest profit level an investor has reached in the service.

2. 3 Days Solid: The balance must remain above the HWM for three consecutive days to confirm stability and avoid temporary price spikes.
